Welcome to the website of The Mr. Paul Foundation (“the Foundation,” “we,” “us”). By using mrpaulfdn.org (the “Website”), you agree to these Terms of Use. If you do not agree, please do not use the Website.
1. About the Foundation and this Website
The Foundation is a private foundation established in memory of Paul Cunningham, known as “Mr. Paul.” The Website shares our story and our work and provides a way to contact us. The Foundation does not solicit monetary donations, and nothing on the Website is an offer or solicitation to give money.
2. General information only
Statements about the benefits of art and music are offered as general information. They are not medical, therapeutic, educational or other professional advice, and they are not a substitute for guidance from a qualified professional who knows your child.
3. Donating musical equipment
We gratefully accept used musical equipment, which we restore and sell to fund our mission. If you choose to give us equipment:
- You confirm that you own the item and have the right to give it to us.
- Ownership transfers to the Foundation when we receive the item. We may repair, sell, give away or recycle it at our sole discretion. Items are accepted and sold “as is.”
- We may decline any item. Please contact us before sending something so we can share current delivery details.
- Shipping and delivery are at your cost and risk. We are not responsible for loss or damage in transit.
- Please remove all personal data, accounts and passwords from any device before you give it to us.
- The Foundation does not provide tax, legal or valuation advice. Please consult your own adviser about any gift. We will provide an acknowledgment of a gift only if and as we state in writing.
4. Grants and requests for help
Our grants and gifts are made at the Foundation’s sole discretion, often quietly and without public announcement. Contacting us does not create an obligation to provide funding, equipment or supplies, and we may not be able to respond to every request.
5. Volunteering and events
Volunteering is voluntary and unpaid. Volunteers may be asked to review and agree to additional guidelines or releases before taking part in an event.
6. Third-party links, partners and affiliate disclosure
The Website links to charities, music programs and event organizers that are independent of the Foundation. We do not control their content, services or policies and are not responsible for them. Mention of a third party is not a guarantee, warranty or endorsement of every aspect of its programs, and the logos and names shown belong to their respective owners and are used only to identify the organizations.
Affiliate disclosure. Some links, including links to Music Together® and Kindermusik® class locators, may be affiliate links. If you enroll or purchase through one of them, the Foundation may receive a small commission at no extra cost to you. Any such income supports our mission.
7. Event listings
The events shown on the Website are organized by third parties. We list them as a courtesy, and dates, times, locations and details can change or be cancelled. Please confirm every detail with the organizer before you plan to attend. The Foundation does not organize, sponsor, supervise or insure these events unless we say so expressly.
8. Intellectual property
The Website’s text, design, graphics, photographs, name and logo are owned by or licensed to the Foundation and are protected by law. You may view and share the Website for personal, non-commercial purposes, but you may not copy, modify or use our name, logo or content for any other purpose without our written permission. Photographs of Mr. Paul and of our volunteers are shared with care and may not be reused without permission.
9. Acceptable use and your messages
You agree not to misuse the Website, including by sending spam or unlawful, harassing or misleading content, attempting to gain unauthorized access, or interfering with its operation. Please do not use the contact form for emergencies, and do not send confidential, medical or financial information. Information you send is handled as described in our Privacy Policy.
10. Disclaimer of warranties
The Website is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, availability or fitness for a particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, the Foundation and its directors, officers, volunteers and representatives will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Website, from third-party sites or events, or from reliance on information on the Website.
12. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Davidson County, Tennessee.
13. Changes to these terms
We may update these terms from time to time. Continued use of the Website after a change means you accept the updated terms. The effective date above shows when they were last revised.
